Agencies360 (“we”, “us”, “our”) operates this website and connects businesses with independent, experienced 360° photographers, most of whom are certified by Google. This policy explains which personal information we collect, why we collect it, with whom we share it and how you can exercise your rights. It is based on the Personal Information Protection and Electronic Documents Act (PIPEDA) and the Québec Act respecting the protection of personal information in the private sector.

1. Who is responsible

Agencies360, 950 Rue Saint-Antoine O, Montréal, QC H3C 1A8, Canada, is responsible for the personal information described in this policy.

2. Personal information we collect

Quote requests and enquiries: name, email address, phone number, company name, business address and the details of your project that you provide to us.
Photographer applications and profiles: name, contact details, city and country, profile photo, certifications, specialties, spoken languages, years of experience, portfolio and, where applicable, a rating. Photographer profiles are only shown in our password-protected photographer directory.
Technical information: IP address, browser type, device information and the date and time of your visit, recorded by our web server for security and operation of the website.
Cookies and similar technologies: see section 7.

3. Why we use your information

To respond to your quote request or enquiry.
To match businesses with a suitable photographer in our network, and photographers with client projects.
To manage our photographer network and the password-protected photographer directory.
To communicate with you about your project or application.
To operate, secure and improve our website.
To comply with our legal obligations.

We only use your information for these purposes or for purposes compatible with them. We do not make decisions about you based exclusively on automated processing, and we do not use your information for profiling.

4. Consent

We collect and use your personal information with your consent, which you give when you send us a request or an application, or through the consent banner for cookies and embedded content. You may withdraw your consent at any time, subject to legal or contractual restrictions, by contacting us at hello@agencies360.com. Withdrawing your consent may prevent us from providing certain services to you.

5. Who we share your information with

The independent photographer assigned to your project or, if you are a photographer, the clients requesting your services.
Service providers who help us operate the website and our services, such as web hosting, email delivery and translation services. They may only use your information to provide their services to us.
FormNX, our online form provider, when you submit one of our online forms (for example a special-offer form). FormNX processes this information on our behalf.
Mailgun (Mailgun Technologies, Inc., USA), our email delivery provider, which sends the verification codes and notifications generated by our online forms on our behalf. For this purpose, Mailgun processes your email address and the content of these messages in the United States.
Partner photographers from our partner list, when you submit a special-promotion form, so that they can contact you by email, telephone (including AI-based telephone assistance) or SMS to prepare your quote. If you have also agreed to receive further offers, Agencies360 and its partners may inform you about further offers by these means.
Google, when you consent to the display of embedded Google Maps and Street View content (virtual tours). Google then processes data under its own privacy policy.
Public authorities, when we are required to do so by law.

We do not sell your personal information.

6. Information processed outside Québec and Canada

Some of our service providers and many of the photographers in our network are located outside Québec and outside Canada. Your personal information may therefore be stored or processed in other countries, where it may be accessible to the authorities of those countries under their laws. Before communicating personal information outside Québec, we assess whether it will receive adequate protection, and we use contractual and other measures to protect it.

7. Cookies and embedded content

We use cookies that are necessary for the website to work, for example to remember your language, to keep you signed in to the photographer directory and to record your consent choices. We do not use analytics or advertising cookies.

Our virtual tours are embedded from Google Maps and Street View. They are only loaded after you accept them in the consent banner, because Google may set its own cookies. You can change your choice at any time using the “Manage consent” button on the website. Details are available in our Cookie Policy.

8. How long we keep your information

We keep personal information only as long as necessary for the purposes described above, or longer where the law requires it. When the information is no longer needed, we destroy it or anonymize it.

9. Security

We use reasonable technical and organizational measures to protect your information, including encrypted connections (HTTPS), restricted access to our systems and a password-protected photographer directory. No method of transmission or storage is completely secure, but we work to protect your information and to respond promptly to any incident.

10. Your rights

Subject to applicable law, you have the right to:

access the personal information we hold about you and obtain a copy;
have inaccurate, incomplete or outdated information corrected;
withdraw your consent;
have your information deleted or de-indexed where its dissemination contravenes the law;
receive your information in a structured, commonly used technological format, or have it transferred to another organization;
be informed of how your information is used and who has access to it.

To exercise these rights, contact our Privacy Officer at hello@agencies360.com. We respond within 30 days, free of charge. If you are not satisfied with our response, you may file a complaint with the Commission d’accès à l’information du Québec (cai.gouv.qc.ca) or the Office of the Privacy Commissioner of Canada (priv.gc.ca). Depending on where you live, you may have additional rights under local law.

11. Children

Our website and services are intended for businesses and professionals. We do not knowingly collect personal information from children under 14.

12. Information for visitors from the European Union, the EEA and the United Kingdom

If you are located in the European Union (EU), the European Economic Area (EEA) or the United Kingdom, the General Data Protection Regulation (GDPR) or the UK GDPR may also apply to the processing of your personal information. In that case, the following applies in addition to this policy:

Legal bases: your consent (Art. 6(1)(a) GDPR) for embedded content, optional cookies, information about further offers and other processing based on consent; steps prior to entering into a contract and the performance of a contract (Art. 6(1)(b) GDPR) for quote requests, including forwarding special-promotion requests to a partner photographer, bookings and photographer applications; our legitimate interests (Art. 6(1)(f) GDPR) in operating and securing the website and in managing our photographer network; and compliance with legal obligations (Art. 6(1)(c) GDPR).
Transfers: we are established in Canada. The European Commission has recognized that Canada provides an adequate level of protection for personal data processed by organizations subject to PIPEDA. Where personal information is transferred to other countries without such a decision, we use appropriate safeguards, such as the standard contractual clauses adopted by the European Commission.
Your rights: in addition to the rights described in section 10, you have the right to restrict processing and to object to processing based on our legitimate interests. You may withdraw your consent at any time; this does not affect the lawfulness of processing carried out before the withdrawal.
Complaints: you have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU or EEA member state of your habitual residence, place of work or place of the alleged infringement, or, in the United Kingdom, with the Information Commissioner’s Office (ICO).
Providing information: you are not obliged to provide personal information. Without your contact details, however, we cannot respond to your request or process your application.

We may update this policy from time to time. The date at the top of this page shows when it was last revised. Significant changes will be indicated on this page.
